it is a mechanism that allows a litigant to defend his rights and freedoms when he claims in a trial before a judicial authority that the legislative ruling upon which the outcome of the dispute depends violates the rights and freedoms guaranteed by the Constitution.

the modalities and conditions of implementing the exception of unconstitutionality are determined by the Organic law No 18-16.
