الصفقات العمومية عقود مكتوبة في مفهوم التشريع المعمول به تبرم بمقابل مع متعاملين اقتصاديين وفق الشروط المنصوص عليها في هذا المرسوم لتلبية حاجات المصلحة المتعاقدة في مجال الأشغال و اللوازم و الخدمات و الدراسات و قد اقر المنظم أن تبرم هذه الصفقات قبل الشروع في التنفيذ كقاعدة عامة و استثناءا يمكن الشروع في التنفيذ قبل الإبرام في حالة الاستعجال الملح المعلل بخطر داهم كما أشارت إليه المادة 12 ضمن شروط و إجراءات محددةو في حالة استراد المنتجات و الخدمات التي تتطلب من المصلحة المتعاقدة المعنية السرعة في اتخاذ القرار بحكم طبيعتها و التقلبات السريعة في أسعارها و مدى توافرها و كذا الممارسات التجارية المطبقة عليها و التي لا تكون مكيفة مع هذه الصفقات
Abstract EN
Summary: Public contracts are written contracts within the meaning of the legislation in force, are concluded before any commencement of performance of services as a general rule, but In cases of imperative urgency motivated by imminent danger, may authorize the commencement of execution before the conclusion of the public contract.
On the other hand, public contracts for the importation of goods and services which, by their nature, require prompt decision by the contracting service, are exempted from the provisions of this Title which are not adapted to those markets, in particular those relating to to the mode of handover.
