Abstract EN

In order to promote investments in real estate domain and reduce the effect of housing crisis phenomenon, the Maghreb states succeeded in finding a contractuel mechanism to support the population in acquiring a real estate property scheduled to be constructed in future, in counterpart of a reasonable price paid in the form of installments.

However, the seller may fail to complete the construction works, giving rise to the non-handover of the scheduled to the beneficiary in one hand, and hence this latter may lose his funds on the other hand.

Therefore, the different legislations of the Maghreb states obliged the seller to provide adequate financial guaranties to warrant the projects executed within the off-plan sale system.
