Procedures for Filing a Cancellation Action before the Palestinian Supreme Court of Justice"Reality and Aspirations"This research study tackled the topic “Procedures for filing a Cancellation Action before the Palestinian Supreme Court of Justice: Reality and Aspirations”, adopting the descriptive-analytical design, aiming at providing a definition of a cancellation action, its characteristics, acceptance conditions, and the court charged with its examination and prerogatives.

Moreover, it aims at describing the procedures adopted for dealing with it before the Palestinian Supreme Court of Justice as well as the sources, characteristics and actual implementation of these procedures.

As the researcher found out that these procedures fall short and do not include all the legal rules, recourse was made to legal procedures and rules found in the Palestinian law of civil and commercial trials, as well as to the principles and regulations established by the Palestinian Administrative Judiciary.

The study offered a number of recommendations: importance of addressing deficient and lacking legislative aspects found in these procedures; urgency of issuing the Palestinian State Council Bill (Palestinian Administrative Judiciary Law), which adopted the idea of “double judiciary” (cancellation and compensation) and litigation at two levels and code of procedures of administrative litigation.
