جوانب من الحياة الأسرية و مكانة المرأة في منطقة توات بالجنوب الجزائري من خلال النوازل الفقهية (ق 12 ه-18 م)‎

Abstract EN

The traditional libraries of manuscripts in the region of Tuat in the south of Algeria consist of many manuscripts of jurisprudential Nawazil of the 12th century Hegira (18th century AD), among which: "Nawazil al-Ghunniya al-Belbalya", in addition to Nawazil al-Zejlawi, Nawazil al-Jenturi, and others.

These Nawazil are considered as one of the important sources of social history, as they provide a clear and real image on the different aspects of society.

Also, the Nawazil treat real events which actually happened and raised to the court to be dealt with, and not fiction.

This explains the orientalists' interest in the Nawazil, in their studies.

Amongst the social issues treated in the Tuwati Nawazil; the family life including marriage, divorce, raising children and alimony.

They also contain a lot of signs related to the status and role of woman in society during that period.

Les placards des manuscrits de la région de Touat, dans le sud de l'Algérie, conservent de nombreux ouvrages jurisprudentiels Nawazil (Fatwas) du 12 siècle H / 18 S, parmi lesquels: « Nawazil Al Ghanya Albalbalia », « Nawazil Zadjlaoui » et « Nawazilo Aljantouri », etc.

Les jurisprudences (Nawazil, Fatwas) sont considérées comme une source importante dans l'histoire sociale, car elle nous donne une image claire et honnête de la société sous différents aspects, et parce qu'elle traite des événements survenus et soumis au pouvoir judiciaire pour les juger, et non des événements fictifs.

C'est pour cela, les orientalistes se sont donc intéressés à ces jurisprudences (Nawazil, Fatwas) dans leurs études et leurs recherches.

Parmi les questions sociales que les livres jurisprudentiels a traité: la vie familiale, ils contiennent également de nombreuses références relatives au statut de la femme et à son rôle dans la société à cette époque là.
