Arabic Abstract

قدمت هذه الدراسة لإبراز شخصية الجصاص عالما من علماء الأمة الاسلامية و عمدة في المذهب الحنفي، ولإبراز قوته في استنباط الاحكام الشرعية من أدلتها التفصيلية وكذلك بيان طريقته في فهم النصوص و قامت هذه الدراسة في بيان منهجه في الاستدلال، ثم مناقشة الأدلة وترجيحه للقول الذي تؤيده الأدلة حسب فهمه ونظرته في حسن الاستدلال بالدليل وفي موافقة شيخه أبو حنيفة أو مخالفته يكشف هذا البحث الترجيحات الفقهية الامام الجصاص في كتابه احكام القرآن و ذلك في بحث المسائل الفقهية في كتابه احكام القرآن و بيان مسائل الاحوال الشخصية و كيفية الاستدلال في النصوص الشرعية و بيان أسس الترجيح عن الامام الجصاص حيث اعتمد الباحث على اسلوب التحليل في ترجيحات الجصاص في طرحة مسائل الاحوال الشخصية في منهج فقهي مقارن، حيث اعتمد الجصاص في ترجيحاته على اصول مذهبه و ما وافق اقوال المذهب الحنفي و خالف فيه آراء الجمهور.

English Abstract

This study was presented to highlight the personality of AlJassas, a scholar of the Islamic Ummah and the most famous In the Hanafi school of thought, and to show its strength in exploring the rulings of Sharia are its detailed evidence As well as an explanation of his method of understanding the texts, and this study carried out a statement of his method in Reasoning, then discussing evidence and tipping it to say that the evidence supports it according to his understanding and look at Good reasoning in evidence and in the approval or disagreed of his sheikh Abu Hanifa.

This research reveals the jurisprudential weightings of Imam AlJassas in his book The Rulings of the Qur'an, and that In examining jurisprudential issues in his book The Rulings of the Qur’an and explaining personal status issues And how to infer in the legal texts and explain the basics of weighting for Imam Al-Jassas Where the researcher relied on the method of analysis in the weighting of the lead in posing issues Personal status in a comparative juristic approach, in which weighting was based on weightings The origins of the doctrine and what he agreed with the sayings of the Hanafi school and disagreed with the opinions of the public.
