Arabic Abstract

يدور موضوع هذه الدراسة حول اختلاف الزوجين على صحة الرجعة و أثره على صحة عقد الزواج دراسة تأصيلية تطبيقية على قانون الأحوال الشخصية الأردني رقم ( ١٥ ) لعام ٢٠١٩، حيث أن هذا الموضوع من الموضوعات الهامة في حياة المسلمين و ينبني عليه آثار كثيرة منها صحة عقد الزواج و توارث الزوجين و إثبات النسب و حرمة الفروج .

فقد بين الإسلام مشروعية الرجعة في القرآن الكريم و السنة النبوية الشريفة و أجمع المسلمين على مشروعيتها، كما أن الرجعة قد تكون وسيلة لإصلاح المجتمع، و الحفاظ على الأسرة الإسلامية التي تعد اللبنة الأولى في بناء المجتمع.

و يأتي اختلاف الزوجين على صحة الرجعة أحيانا من باب الجهل بالأحكام الشرعية كما قد يكون إختلافهم في صحة الرجعة سببه إنكار أحد الزوجين الرجعة أو إدعاء أحدهم حصول الرجعة، مما يضطر أحد الزوجين إلى إقامة دعوى إثبات رجعة أو دعوى إبطال حجة رجعة، لإثبات إدعاءه و لعل هذه الدراسة محاولة لبيان آراء الفقهاء في الرجعة و كيفية حصولها في الفقه الإسلامي وبيان أركانها و شروطها وفقا للمذاهب الفقهية المعتمدة، و أيضا تطبيق فرضيات إختلاف الزوجين على صحة الرجعة بالقول و الفعل على قانون الأحوال الشخصية الأردني رقم ( ١٥ ) لعام ٢٠١٩، و بيان وجه الفصل فيها وفق القانون، سيما أنه لم يتم تطبيق فرضيات الرجعة وفق هذا القانون، و يكون بذلك قد تم بيان آلية إثبات الرجعة أو إبطالها و أحكامها و شروطها و أركانها .

English Abstract

The subject of this study revolves around the difference between spouses on the validity of irreversibility and its effect on the validity of the marriage contract.

An original, applied study on the Jordanian Personal Status Law No.

(15) of 2019 As this topic is one of the important topics in the life of Muslims and many effects are built upon it, including the validity of the marriage contract, the inheritance of spouses, the establishment of descent and the prohibition of marriage Islam has shown the legitimacy of irreversibility in the Noble Qur’an and the noble Prophet’s Sunnah, and Muslims are unanimous in its legitimacy, just as regression ma> be a way to reform society and preserve the Islamic family, which is the first building block in society.

Sometimes the difference between the spouses on the validity of the reaction is a matter of ignorance of the legal rulings, as their difference in the validity of the reaction may be due to the denial of one of the spouses, or the claim of one of them to take back, which compels one of the spouses to institute a case to prove the irreversibility or a claim to annul the irreversible argument, to prove his claim.

Perhaps this study is an attempt to clarify the opinions of jurists in the reaction and how it happened in Islamic jurisprudence and its elements and conditions according to the approved doctrinal doctrines, and also the application of the hypotheses of the difference of the spouses on the validity of the reaction in words and deeds to the Jordanian Personal Status Law No.

(15) for the year 2019, and to clarify the aspect of the separation according to The law, especially since the assumptions of irreversibility have not been applied in accordance with this law.

and by this the mechanism of proving the reversal or its nullity, its provisions, terms and corners has been clarified.
