According to the general rules of civil law, legal acts submit in its creation to the party autonomy principe which is expanded or “tighten” restricted depending on the act nature and its affiliation to public or private law fields, however relative to the specificity of certain acts it may require some formal procedures for protecting parties act and other interests and also the public interests may be impose the intervention of legislator by imposing cetain formality rules in conclusion of some legal acts, The use of information and communication technologies for the conclusion of contracts, in particular via the electronic payment card, therefore It is necessary to adapt formalism's rules with the particularity of the electronic transaction.
