We can say that the duty of the administration when practicing its authorities in the field of administrative controle is to make a balance between requirements of keeping general order and individual practices which the law guarantee.

However, this does not exempt the state from its responsibility, in addition compensate people for damages which affect them through initiating its function.

From here comes the role of the legislator and the Algerian judiciary in recognizing the authentication of state responsibility on its concrete licit works and illicit ones in keeping general order based on the theory of error also risks, showing the importance of reconciliation law in anchoring it from the side of judiciary applications in ordinary and exceptional circumstances.
