This paper is devoted to investigate the Lease Contract in both Algerian and French legislators.

The objective of this study is to illustrate the similarities and differences between the provisions of this legal system in both countries, taking into consideration the fact that the French legislator was a pioneer in arranging the provisions of this Lease Contract.

In 1984, the French legislator attempted to organize all aspects of the Lease Contract under law n° 84-595 issued in July 12, 1984.

Whereas, the Contract did not take its final shape in the Algerian legislator till 2001 with the issuance of the executive decree n° 01-105 of April 23, 2001.
