Abstract EN

The legal basis of the value of cooperation between spouses, the interpretation of transformations related mainly to their mutual contribution in running of family affairs, education of children and financial transactions, have led the legislator to combine all rights and all conjugal obligations as provided for by article 36 of the family code .

Due to the evolution of financial relationships within the family motivated by woman’s work, the funds of the spouses are mixed up because the wife participates in the costs and expenses of married life.

The legislator, through the amendment of the family Law, authorized the spouses to agree by means of prenuptial agreement or by means of a subsequent authentic agreement, on postnuptial acquests.

The legislator tried to unify rights and obligations between spouses and to unify financial cooperation, which is known as the prenuptial agreement
