من المبادئ الأساسية و الهامة التي تعتمدها معظم الدول و تكرسها في دستورها مبدأ الفصل بين السلطات الذي يعكس بحق مدى تطبيق الدولة للقانون.
و إن هذا المبدأ لشديد الصلة بآخر ألا و هو اسقلالية القضاء.
و مفاد هذا الأخير أن الأحكام التي تصدر عن القضاء ينبغي أن تكون حيادية متحررة من أي قيد وليد ضغط أو نفوذ قد تمارسه سلطة أخرى أو جهة قضائية معينة.
و لذلك فإن الدستور يعمد إلى ضمان هذه الاستقلالية بواسطة هيئة متمثلة في المجلس الأعلى للقضاء.
فهل هذه الاستقلالية محترمة
Abstract EN
One of the fundamental and important principles adopted by most States and enshrined in their Constitutions is the principle of the separation of powers, which truly reflects the extent to which the State applies the law.
This principle is closely linked to other than judicial independence, which means that judgments rendered by the judiciary should be impartial and delivered from any restric-tion resulting from the pressure or influence that might be exerted by another particular judicial au-thority or authority.
For this reason, the Constitution is no less a guarantor of this independence through a body called the Supreme Judicial Council.
Is this inde-pendence respected?

Un des principes fondamentaux et importants adoptés par la plupart des Etats et consacrés dans leurs Constitutions est le principe de la séparation des pouvoirs, qui reflète réellement la portée de l'application de la loi par l'Etat.
Ce principe est très lié avec autre qu'est l'indépendance judiciaire, la-quelle signifie que les jugements rendus par la magistrature devraient être impartiaux et délivrés de toute restriction issue par la pression ou l'in-fluence qui pourrait être exercée par une autre autorité ou une autorité judiciaire particulière.
Pour cela, la Constitution n'est pas moins qu'un garant de cette indépendance par le biais d'un or-gane dit Conseil supérieur de la magistrature.
Cette indépendance est-elle respectée?
