Abstract EN

In this article, we elaborate the subject of maintenance, approved by the Algerian legislator for the child entitled after the separation of his parents; as one of the most important regulations that came out to protect the child in the physical side, and we identify some of the problems revealed during our research, and which are mainly, the difficulties of estimation and evaluation and trying to examine the reasons behind that.

Those challenges turned out to be either due to the legal texts deficiency, or because of individual malpractices to evade maintenance, and hence, trying to find effective remedies to those problems, relying on judicial practices and pioneering legislative experiences.
