إن حماية حقوق الأشخاص ذوي الاحتياجات الخاصة و الاعتراف بها من أهم الالتزامات المرتبطة بحقوق الانسان باعتبارها فئة تحتاج إلى رعاية و تأهيل مما استدعى الاعتراف بحقوقهم ضمن مجموعة من النصوص القانونية والوطنية الدولية و هو ما جاء به المشرع الجزائري بموجب القانون رقم 02-09 لسنة 2002 و المتعلق بحقوق الأشخاص المعوقين و ترقيتهم و الذي يعتبر خطوة أخرى إلى الأمام لضمان حقوق هذه الفئة الهامة من المجتمع و حمايتهم من جميع أشكال التهميش و اللامبالاة.
Abstract EN
The protection and recognition of the rights of persons with special needs are of the most important human rights obligations, as a group that requires community care and rehabilitation, which necessitates the recognition of their rights within arange of national and international legal texts.
This is what the Algerian legislator said according to law N° :02-09 which the protection of peple with disabilitiesis a further step for ward in guarauteeing the rights of this important –category of society, and to protect them from all forms of margina lization and in difference.

des personnes ayant des besoins spéciaux sont l’une des obligations les plus importantes en matière de droits de l’homme, en tant que groupe qui exige des soins et une réhabilitations communautaire, ce qui nécessite la reconnaissance de leurs droits dans une gamme de textes juridiques nationaux et internationaux.
C’est ce que le législateur Algérien a déclaré conformément a la loi N° : 02-09 concernant la protection des personnes handicapées est un pas de plus dans la garantie des droits de cette importante catégorie de la société, et de les protéger de toute les formes de marginalisation et d’indifférence.
