يترتب على اتفاق التحكيم أثران أحدهما سلبي و الآخر إيجابي : أما الأثر السلبي فيتمثل في التزام الطرفين بالامتناع عن الالتجاء إلى القضاء للفصل في موضوع النزاع محل التحكيم التزاما يترتب عليه غل يد القضاء عن النظر فيه و أما الأثر الايجابي فيتمثل في إجازة التجاء الطرفين إلى هيئة التحكيم المتفق عليها للفصل فيه وفقا للشروط التي ينص عليها اتفاق الطرفين و أحكام القانون المنظمة للتحكيم.
و إذا كان هذان الأثران مترتبان على الاتفاق على التحكيم فإن قيامهما يكون رهينا بصحة هذا الاتفاق و بقاؤهما يكون رهينا ببقائه
Abstract EN
The arbitration agreement has two effects, one positive and the other negative: The negative impact is the commitment of the parties to refrain from going to court to rule on the dispute being arbitration, commitment resulting in the elimination of the jurisdictional consideration.
The positive effect is that the parties to the approved arbitral tribunal are allowed to rule in accordance with the conditions provided for by the parties' agreement and the provisions of the arbitration law.
If these effects result from the arbitration agreement, they are bound by the validity of this agreement and their survival depends on the survival of the latter.

La convention d'arbitrage a deux effets, l'un positif et l'autre négatif: L'impact négatif est de l'engagement des parties à s'abstenir de recourir à la justice pour statuer sur le litige faisant l'objet d'un arbitrage, engagement aboutissant à l'élimination de la considération juridictionnelle.
L'effet positif est que les parties au tribunal arbitral agréé soient autorisées à se prononcer conformément aux conditions prévues par l'accord des parties et aux dispositions de la loi sur l'arbitrage.
Si ces effets résultent de la convention d'arbitrage, ils sont liés par la validité de cette convention et leur survie dépend de la survie de cette dernière.
