Abstract EN

This research deals with the reality of refrainment and its provisions: a jurisprudential study through which I dealt with the various forms of refrainment (silence, abandonment and abstention), and the definition of these forms linguistically and conventionally.

For each section, I have mentioned some related jurisprudential issues which are renewed old jurisprudential issues related to the society in which I live.

The research problem was identified in a major question: What is the reality of the refrainment and its provisions? and by studying some of the jurisprudential issues related to the forms of refrainment.

The study intended, through its main question, to define the concept of each form (silence, abandonment and abstention) and present some jurisprudential issues related to each form separately.

The research stemmed from the fact that a jurisprudence knowledge in religion is one of the most important matters that a Muslim must be aware of, so the wisdom of creation lies in the worship of Allah Almighty, and that the correct and proper worship can only be through the knowledge of Islamic jurisprudence along with its evidence and provisions.

I reached to a set of results, including: • Refrainment varies in several forms, including: abstention, silence and abandonment, and each of them has its own provisions.

• A person is responsible for his actions if the obstacles have disappeared, namely Knowledge, eligibility, possibility and choice.

• Refrainment can be permissible if there is no harm for the person in the case of abstention.

• Refrainment is forbidden if it leads to death of a person or loss of one of his/her members.

• Abstention, silence and abandonment vary according to the provisions of assignment and the conditions of the assignees.

• Research issues and its parts have many sections, so I have selected some of them as an example.
