Abstract EN

Both of the Algerian and Moroccan legislators grated the electronic consumer an option that enables them to refer to the contract thatwas concluded during a certain period, for this, the purpose of this study was to remove confusion on the provisions on which the right to withdraw in theelectronic consumption contract is based and to clarify the procedures that the consumer follows to exercise this right and the effects arising from it in both the algerian and moroccan legislation.

However, the the Moroccan legislator was more protective of the weak party in the contract, that is, the electronic consumer, by giving him real guarantees in order to activate his right to justice, while the Algerian electronic commerce law was less protected, in addition, to the lack of articles that regulate this right, as it was limited to only two brief articles.
