Abstract EN

The reasons behind the selection of the former judicial system are summarized in the approximation of the judiciary to the litigant with the simplification of procedures and the limited mumber of judges.

however, over time, the need to establish a new organization that responds to the needs of the country has become imperative.

the article 152 of 1995's Constitution in the section dedicated to the judicial authority ended the existence of the former judicial system and introduced the dual judiciary system which is characterized by the presence of two independent judicial systems, the ordinary judiciary and the administrative judiciary, in addition to the disputes court which is also a judicial institution at the top of the judicial system hierarchy.

the existence of two systems requires the determination of specialty distribution criteria from the judicial entities associated with the law and the administrative judicial entities (state council and administrative courts).
