Consequently, the employment contract parties are free to agree on the terms of the contract.

However, the nature and specificity of its parties, which are characterized by economic inequality, prompted the legislator to intervene, by organizing them in order to preserve the stability and balance of work relations, as well as to achieve the general social order.
