استهدفت الدراسة الحالية تقييم عقوبة جريمة الزنا في قانون العقوبات المصري و الجزائري في ضوء ما قررته الشريعة الإسلامية في هذا الخصوص.
و استندت الدراسة إلى المنهج الوصفي.
و اعتمدت في إطار ذلك على الأسلوب التقويمي.
و تمثلت أداة الدراسة في مسح الأدبيات المتعلقة بموضوع الدراسة.
و أسفرت الدراسة عن العديد من النتائج أهمها : أن الشريعة الإسلامية أوجبت عقوبة القتل رجما بالحجارة حتى الموت على الزاني المحصن و عقوبة الجلد و التغريب على الزاني غير المحصن-أن العقوبة المقررة–لجريمة الزنا-في قانون العقوبات المصري هي عقوبة الحبس و هذه العقوبة تخالف ما تقرره الشريعة الإسلامية- أنه مع أهمية ما تفرد به قانون العقوبات الجزائري في عدم التفرقة–في مقدار العقوبة-بين زنا الزوجة و زنا الزوج إلا أن هذه العقوبة تخالف أيضا ما تقره الشريعة الإسلامية.
و أوصت الدراسة المقنن الجنائي المصري و الجزائري إلى ضرورة التدخل لرفع العقوبة المقررة لجريمة الزنا إلى عقوبة القتل رجما بالحجارة حتى الموت على الزاني المحصن و عقوبة الجلد و التغريب على الزاني غير المحصن بما يتفق مع ما أوجبته الشريعة الإسلامية في هذا الخصوص.
Abstract EN
The study aimed at evaluating the penalty of adultery and fornication offences according to Egyptian and Algerian Criminal law in the light of Islamic Law (Shari'a).
The study used the descriptive methodology to reach the targets in question.
To gather the required data, a review of literature was administered.
The study came to the conclusions that: first.
Islamic Law (Shari'a) imposes the death penalty for the married adulterer and whipping and expulsion penalty for the unmarried adulterer (fornicator); second, the Egyptian and Algerian Criminal law impose imprisonment penalty for the convicted of adultery offence and this contradicts what Islamic Law (Shari'a) necessitates.
The study recommended that the Egyptian and the Algerian Criminal law ought to adopt the death penalty for the married adulterers and whipping and expulsion penalty for the unmarried adulterers (fornicators) in response to what what Islamic Law (Shari'a) requires.
