Abstract EN

This paper deals with the study of the provisions of membership in the Constitutional Council in the light of the constitutional amendment of 2016, with the aim of examining the extent of the organization's independence independently, which was a basic justification for questioning the objectivity of the oversight functions of the Constitutional Council since its inception, and that is based on the comparative descriptive analytical approach.

The Algerian founder registered membership in the Constitutional Council with age and legal experience, but it did not achieve the principle of equal opportunity for reporting between each of the legislative, judicial, and executive authorities, which may affect the independence of membership of the Constitutional Council, which is mainly based on constitutional and organizational guarantees Determined to protect the legal status of members of the Algerian Constitutional Council.
