The spread of the Coronavirus, that has become a global pandemic, has led to a declaration of a health emergency, the thing that has allowed the governments to make the appropriate laws and procedures in order to reduce its spreading.

Nevertheless, the state of emergency and the procedures related to it have opposed to freedoms and rights, and perhaps the most notably one is the right to work, since a lot of employees and workers have lost their career and job.

Therefore this study aims to underline the concept of the state of emergency, its legal basis, and how it affects the right to work.
