استهدفت الدراسة الحالية بيان مدى اعتناء التشريعين المصري و الجزائري بشرط الجنسية في زوج المترشح لمنصب رئاسة الدولة و تقييم ذلك في ضوء ما أقرته الشريعة الإسلامية.
و تمثلت أداة الدراسة في مسح الأدبيات المتعلقة بموضوع الدراسة.
و أسفرت الدراسة عن العديد من النتائج أبرزها الآتي: أن المعتبر في زوج المترشح لمنصب الرئاسة في الفقه الإسلامي هو شرط الدين لا شرط الجنسية- أن المعتبر في زوج المترشح لمنصب الرئاسة في الدستورين المصري هو جنسيتها بغض النظر عن ديانتها و مذهبها و ما إذا كانت ملتزمة بأداء فرائض دينها أو لا.
- أن الدستور الجزائري ذهب إلى ما ذهب إليه الدستور المصري من الاعتداد بشرط الجنسية – لا شرط الديانة - في زوج المترشح لمنصب رئاسة الدولة- أن الاعتداد بشرط الجنسية – لا بشرط الديانة - في زوج المترشح لمنصب الرئاسة يتنافي مع تعاليم الشريعة الإسلامية التي أعطت الأولوية لشرط الدين و الاستقامة- أوصت الدراسة بضرورة النص على اشتراط أن تكون زوجة المترشح لمنصب رئاسة الدولة مسلمة منتمية لمذهب أهل السنة و الجماعة و ملتزمة بإقامة فرائض دينها.

Abstract EN
The study aimed at evaluating the wife's nationality pre-requisite stipulated for the presidential candidate according to Egyptian and Algerian Legislations in the light of Islamic Law (Shari'a).
The study used the descriptive methodology to reach the targets in question.
To gather the required data, a review of literature was administered.
The study came to the conclusions that: first the Islamic Law pays attention to the religion – not the nationality – of the presidential candidate's wife; second, unlike the Islamic Law, both the Egyptian and Algerian Constitutions pay attention to the nationality – not the religion - of the presidential candidate's wife, which breaks the Islamic teaching in this regard.
The study recommended that the Egyptian and Algerian Constitutions ought to regard the religion – not the nationality - of the presidential candidate's wife.
