Principle of the best interests of the child is considered as one of the fundamental principles of the 1989 Convention on the rights of the child where it was widely applied in the internal laws of countries as an explanatory and guiding principle that should be consulted and guided when interpreting and applying the texts relating to the rights of the child.

Both Algeria and France have paid great attention to this principle by adopting it in many legislative texts, as the judiciary in both countries had a role in putting it into the implementation and control over its application and even extended the order of French judiciary - at times - to the realization of its discretion even in the abolition of the legal text that is contrary to the best interests of the child.
