Abstract EN

Custody is one of the most important and most serious judicial procedures granted by the Algerian legislator to judicial police officers, when conducting investigations, inquiries and information gathering of committed offenses, though, the legislator has tried to define and limit this measure by certain formalities, so that the person suspected of having committed the crime is arrested at the security headquarters or the national gendarmerie, less than the maximum period as determined by the law, all respecting the application of a set of requirements for judicial police officers, on one hand, and to ensure, on the other hand, that the rights and freedoms of detainees in police custody won’t be violated, neither through abuse of authority nor repression when applying this procedure by taking into custody someone against whom there is an offense .This is how the legislator managed to make a real qualitative leap in favour of a serious commitment concerning the respect of individual’s rights and sanctity of their private lives
