The Algerian legislator has put in place an appropriate legal framework for the lessee of commercial leases in commercial law, in order to keep him his business, by granting him the right to renew the lease as soon as it expires.

but in the event that the lessor refuses to renew the lease contract, he is obliged to pay eviction compensation.

On the other hand, Law n: 05/02 of: February 06, 2005, the lessee is required to leave the leased premises at the end of the term fixed by the contract without notice of leave and without claiming eviction compensation.

this amendment negatively affected the protection of the tenant and his business, as well as the balance of interests between lessor and tenant
