Abstract EN

The Algerian legislator dedicated the principle of property freedom, which is an integral part of the constitutional principle of guaranteeing private property in Article 64 of the Algerian Constitution of 1996, in order to preserve the private interest of the owner of the property in his right to exploitation and disposal.

Where the Algerian Urban Law is balanced between the public interest and the private interest, on the one hand gives the people the right to freedom of real estate and claim their right to obtain a building permit or a retail license but in accordance with legal and regulatory procedures related to the Algerian building and construction legislation starting from submitting the application and attaching it to all files and documents (The President of the People's Municipal Council-the Governor-Minister in Charge of Urbanization) has the right to use any method of appeal.

On the other hand, the Algerian legislator obliged the competent administrative authorities to issue building permits Or retail to respect legal procedures in the field of urbanization without abuse of power and deprivation of individuals from their urban rights.
