العلاقة بين الملكية الفكريةوالنظام العامبحث مقدم م.
د اندلس حامد عبد /كلية القانون - جامعة بغداد- العراقوزارة التعليم العالي و البحث العلمي تعد الملكية الفكرية نتاج فكر الإنسان من إبداعات كالاختراعات و المؤلفات و النماذج الصناعية و العلامات التجارية و الأغاني و الرموز و الأسماء و لا تختلف حقوق الملكية الفكرية عن حقوق الملكية الأخرى، فهي تمكن مالك الحق من الاستفادة بشتى الطرق من عمله الذى كان مجرد فكرة ثم تبلور إلى أن أصبح في صورة منتج.
و يحق للمالك منع الاخرين من التعامل في ملكه دون الحصول على إذن مسبق منه، كما يحق له مقاضاتهم في حالة التعدي على حقوقه و المطالبة بوقف التعدي أو وقف استمراره و التعويض عما أصابه من ضرر.
و أتجهت عدة بلدان لضرورة وضع قوانين تنظم الملكية الفكرية.
أما دوليا فقد تم التوقيع على عدة معاهدات لنظام الملكية الفكرية وذلك لحماية حقوق المخترعين من تعدي البعض على اختراعاتهم دون الحصول على إذن مسبق منهم و المحافظة على السلامة العامة وذلك بإخضاع المنتجات للمحاسبة القانونية و منع الاعتداء عليها كونه انتاج ذهني و لا بد من حماية الحقوق الادبية و المالية و منحه الوسائل التي تؤمن تلك الحماية القانونية لهذا الانتاج الفكري.

Intellectual property is the product of human thought such as inventions, literature, industrial designs, trademarks, songs, symbols and names.
Intellectual property rights are not different from other property rights.
It enables the owner to benefit from his work in a variety of ways.
The law provides legal protection for humanityIntellectual property may be exposed to the types of violations that affect these rights.
Violations vary according to the nature of the rights you are attacking.
The rights of authors may be attacked by selling, renting, or publishing in ways that are not authorized by the owner of the works
