The principle of the independence of the constitutional Justice is considered one of the most important principles in the State, this importance comes from the importance of the constitutional Justice as an organ in various fields: constitutional, legal, social.

; as it reinforces the foundations of the State based on the supremacy of the Constitution and ensures respect for its provisions and principles, as well as the protection of the fundamental rights and freedoms of the citizen.

And Since the Constitution defines the three powers of the State and determines its powers, the latter must respect the framework established by the Constitution.

Thus, the Constitutional Justice has been established to exercise control over the actions of these authorities, but this control requires its independence toward them, and based on this the ''principle of the independence of the constitutional Justice'' was born, which is addressed in this paper.

We also discussed the model of the Constitutional Justice in the Russian Federation and the embodiment of this principle, given its historical background in this area especially through the ''Constitutional crisis'', and on the other hand because it is a federal State, which makes guarantying this principal even more challenging.
