تشهد البشرية أزهى عصور حقوق الإنسان و لا شك أن قادم الأيام سيكون الأزهى ذالك لان هناك نظاما قانونيا ظهر يعرف بالقانون الدولي لحقوق الإنسان هذا الواقع يطرح إشكالية حول مدى تلاؤم هذا النظام القانوني مع حق إجرائي يعترف به قانون المعاهدات للدول و هو التحفظ.
عالج هذا المقال معالجة إشكالية مستقبل التحفظ على الاتفاقيات الدولية لحقوق الإنسان وفق القواعد الثابتة في قانون المعاهدات و ما درجت عليه ممارسة الدول حيث نلحظ تناميا لإجراء جديد يعرف بالإعلانات التفسيرية هل بطل التحفظ و اعترف للدول بحق إبداء إعلانات تفسيرية أم أن الدول ابتدعت حيلة قانونية لتجاوز ذالك وعليه فان الإعلان التفسيري هو تحفظ ضمني.

Abstract EN
The emergence of the international human rights law is a proof of the slow but sure march of international law towards the construction of an effective and fair international legal order where the respect of human rights, in all time is its first concern.
This progress makes the future of the reserves - which is a right recognized to the state of by the law of treaties- uncertain.
This article responds to this problem in the light of the modern practices of States, especially with the common use of a process called interpretative declarations.
