Abstract EN

Penal order is a vehicle with specific features through which penal proceedings can be brought to a close.

It is a practical, abbreviated tool for ending criminal lawsuits easing the burden on judiciary without detriment to interests of parties to criminal lawsuits.

However, the application of such vehicle draws criticism and is not without its impediments, including the selection of the body authorized to issue such order and the scope of the order.

The aim of this research is thus to determine authorized body as well as scope of the order.

With that end in view, research employs descriptive, analytical approach: research provides a definition for penal order, and sets forth its characteristics, conditions, the entity authorized by law to issue the order, scope of the order, cases of issuance, a modern model of its application in UAE, assessment of penal order system and finally a conceptualization of the activation of penal order.

Findings and recommendations included: enhancing legal control; granting public prosecution the authority to issue penal order and ensuring integration of penal order with other litigation- ending legal tools such as criminal conciliation system.

Research argues that such development measures will help activate the role of penal order to achieve intended goal, and enhance integration with other procedural tools employed for the same purpose
