Through our study of the subject of custody in mixed marriages, The Algerian law and the other comparative laws, especially Arabic ones, have paid great care to protect the interests of the child, and also to The opinions of jurists and the jurisprudence of the judiciary issued in this regard, and the difference in the legal nature of custody has in turn led to a difference in the applicable law.

Most States did not establish a rule of attachment, which led to the conclusion of bilateral treaties and international conventions such as the Hague Convention of 1961 on the powers of the authorities and laws for the protection of minors, because the child is the man of the future
