Abstract EN

Marriage is considered one of the most dangerous contracts that a person provides for the sake of tranquility and security and the implications of the great purpose of the continuity of human offspring on the ground.

Al though the jurists differed concerning the number and conditions of the marriage contract, it is agreed that the marriage should not be held without the conditions and conditions of marriage.

This is in case of marriage contract in its original form, but it may be that one of the parties to this great contract is incomplete.

And after that has not yet matured and there for this situation requires special provisions and procedures, wich led to the islamic sharia to provide that special care for this matter, where they were entrusted with looking at their affairs and managing them to those who care about them and protect them and act in them for the benefit of them ,the guardian.
