This study aims to examine the jurisdiction over the disputes arising out of the administrative contracts, explain position of the legislator and the Jordanian administrative court on such jurisdiction and compare it with the position of comparative legislator and judiciary.

In light of failure to include looking into the disputes arising out of the within jurisdiction of the Jordanian administrative court, the study shows that the Jordanian administrative judiciary argues that looking into such disputes is beyond its jurisdiction.

This means that looking into such disputes is attributed to the civil court which results in prejudice to privacy of such contracts which are concluded by the State with the aim of managing the public utilities steadily and regularly.
