If he does not have the material means to do so, or is unable to exploit the patent subject for any reason, he or she shall be entitled to authorize others to exploit the patent and we shall be in the process of contractual licensing.

In the event that he is not committed to exploiting the pharmaceutical patent or its exploitation is insufficient, then the state interferes and exploits the patent without the consent of the patent owner by granting others compulsory exploitation licenses for the patent, and here we are in the process of compulsory licensing, which is the subject of this paper.
