يقصد بفكرة النظام العام الحمائي تلك القواعد القانونية التي تهدف إلى حماية الطرف الضعيف في العلاقة العقدية من خلال إقامة التوازن الاقتصادي و المعرفي بين المتعاقدين.
و لإبراز معالم هذه الفكرة يتعين تحديد مفهومها و بيان تطبيقاتها في التشريع الجزائري.
Abstract EN
public protection order is a set of legal rules that aim to protect the weaker party in the contractual relationship through making balance in knowledge and economy among contractors.
To highlight the features of this concept, we must define it first and then show how it can be applied in the Algerian Legislation.
