تعتبر مرحلة المفاوضات أساسية لإبرام العقود خاصة العقود الالكترونية حيث أن الأصل فيها حرية التعاقد وقد استهدفت دراسة بحثنا تحديد مفهوم المفاوضات في عقد الالكتروني وذلك من خلال تعريفه و بيان خصائصه و كذا دراسة المراحل التي يمر بها و طرق إبرامه كما تناول البحث الالتزامات المترتبة عن مرحلة التفاوض في العقد الالكتروني و ضرورة الالتزام بها إذ أن الإخلال بها يرتب عنه قيام المسؤولية.

The negotiations phase is essential for the conclusion of contracts, especially electronic contracts, where the origin is free to contract, and the study of our research aimed to define the concept of negotiations in the electronic contract through the definition and description of its characteristics, as well as study the stages and ways of conclusion.
