Abstract EN

The research is focused on the idea that the books written by the Malekites of Islamic Maghreb have a variety of benefits and knowledge that have a relation with different sciences such as interpretation* history and doctrine.

This article aims* through somecase studies of the jurisprudence contained in the book « Hilalite jurisprudence » by Sidi Ibrahim Ibn Hilal Al-Sijilmassi (died in 903 hijir) to find out the origins of the advisory doctrinal opinions (Al Iftae) and the approach used regarding the treatment of matters (questions) of the doctrine.

The research includes two main topics.

The first topic gives an insight about Al Ifta origins according to Ibn Hilal al-Sijilmassi.

The second is devoted to presenting some issues that can serve as models for the evidentiary assets that he adopted in his doctrinal fatwa.

The main conclusion of this research is that Ibn Hilal did not limit his doctrines to theoretical issues* but he also responded to many questions that were related to the reality and concerns of the applicants of the advisory opinions.

This indicates that those opinions clearly reflect the nature of intellectual and doctrinal problems that prevailed in the Maghreb in the century in which the Ibn Hilal lived.
