التفسير المقاصدي للنصوص الشرعية عند الإمام مالك في كتابه الموطأ

Abstract EN

This research is considered as a scientific attempt to highlight legal- objectives emplyoment for Imam Malek when looking at legislative texts in his book 'Al-Mowatta.' We, therefore, demonstrated the concept of purpose-oriented interpretation of legislative texts, and we presented a number of regulations which have to be taken into account during the jurisprudence process together with bringing some reinforcing evidences from Imam Malek School of Law.

After that, we gave examples which show the strong presence of legal-objectives science and its rules in terms of how Imam Malek interprets legislative texts in such a way that preserves the revelation sacredness, helps the concerned person achieve their goal, and helps overcome social problems.

Legal-objectives employment is a realistic, rational and moderate approach, away from the literal and apparent meaning of the text or relying on reality and its ailments.
