Abstract EN

Political jurisprudence is considered to be one of the most conflictual and paradoxical branches of jurisprudence all along the history of the Islamic heritage.

This may be due to the fact that there are no detailed provisions in the Qur'aan and the Sunnah.

Rather' it is subject to jurisprudence' the provisions of which vary according to circumstances and conditions.

Therefore' the setting up of political jurisprudence and linking it to its maqassid (purposes) are considered one of the most important scientific projects which should be taken seriously into consideration.

Because in doing so' we will be able to come out of the political jurisprudence of the narrow cycle of fragmentation' infractions and details to the spaciousness of the total purposes and rules' and this will undoubtedly narrow the scope of divergence and expand the one of consensus.

This study is' thus' intended to contribute to the issue of political jurisprudence through the formulation of some general rules and reasoning from the Qur'aan and the Sunnah' based on the method of analytical induction' and the study of a range of political issues within the framework of the cited rules' which will provide the possibility of weighting between different opinions within the same case.
