Abstract EN

Arbitration is considered an effective legal method in resolving administrative contract disputes in many countries at the present.

The Jurisprudence and Judiciary are in different viewpoints about the issue.

Some of them support taking the way to the Arbitration in resolving administrative contract disputes and the others oppose the idea.

Every party has its justifications, arguments and evidences.

But whoever rejected the idea earlier, they finally have changed their minds and legalised it.

Accordingly, the jurisprudence and judiciary have taken that in their works.

The Yemeni legislator legalises the permissibility to go to Arbitration in resolving administrative contract disputes, whether they are national or international disputes.

Moreover, the Yemeni legislator explicitly has included that in the legislations and considered it a basis in some of acts.
