This paper aims to examine the penalty clause in the contract of rent credit under Algerian legislation, in particular Decree No.

96-09 which is one of the most important guarantees listed by the lessor for the proper execution of the contract.

However, this requirement may be exaggerated, allowing the judge to amend it in accordance with the provisions of the above-mentioned order, as well as in accordance with the general rules, in order to create balance between the parties.
