StudySummary: Since its creation, the Algerian constitutional council has played an important role in consolidating the foundations of the rule of law, as a constitutional institution which ensures the supremacy of the constitution, apart from other fundamental specialties, the council has an attached role of monitoring the elections and referendum, is a role which ensures the functioning of the democratic process in the best conditions, which can have a positive reflection on the establishment of the foundations of the rule of law.

In the current situation of what Algeria, has been going through from a major transformation process since February 22, 2019, and the accompanying popular demands on top of which, to work to strengthen the functioning of the rules of the democratic process, we are trying to highlight the important oversight role of the constitutional council regarding the validity of the elections and referendums, in the current Algerian legislation.
