This study aims to highlight one of the confusion sides within the recent jurisprudential study, which is the overstatement in asking the legal evidence concerning any branch issue without any consideration of the asker ability neither the conditions of argumentation.

It is so evident that the spread of this phenomenon conceals a great deal of faults and causes that the study tries to deal with.
