There is no doubt that the genetic fingerprint has an important role in the field of establishing lineage, even if this role is not achieved or acquires its extreme importance except in respect of a set of conditions and controls that must be met in order for the results of this technique to be approved, especially after the Algerian legislator stipulated in the text of Article 40 on the permissibility of resorting to Scientific methods of establishing lineage, but the matter is not that easy, as the use of this measure may face some problems and difficulties, and the reality is that the more it is possible to overcome these difficulties the more we pave the way before the judiciary because it achieves Islam’s longing for preserving lineage from mixing.

Therefore, we will try to discuss in this article the legal position that the scientific method technology enjoys in the field of establishing lineage, after which we will explain the difficulties and problems raised by the use of the genetic fingerprint as a scientific evidence in proof and the position of the Algerian legislator towards it.
