Despite the legislator's attempt to provide greater guarantees in light of the new organization of working time and its distribution, by imposing peremptory rules of public order that prohibit the use of layoffs as a first option, seeking to reconcile between the necessities of competition and the requirements of flexibility on the one hand and the protection of workers in a way that serves their interests and ensures social and employment stability for them.

However, the current of globalization has opened a wide field for institutions to find an alternative to layoff in the context of what is expressed by "moral harassment" in all its forms as a strategic weapon that paves the way for ending the work relationship at the lowest costs.
