Abstract EN

The aim of this research is to demonstrate the status of cultural property, given the importance, that cultural heritage represents in the lives of nations and peoples, how much it embodies and expresses its cultural identity and values, as well as a common heritage of all humanity.

Finally, we have reached a number of conclusions: Cultural property is a natural right of each State and has the right to defend it and to demand its recovery in the case of theft or smuggling, or to stop such violations, compensation or all, with the need not to accept compensation as a penalty unless all other means are exhausted.

In addition to the ineffectiveness of public and private protection systems in achieving the desired protection of cultural property, this led to the creation of a new system to ensure more effective legal protection of such property, which relates to enhanced protection of cultural property.
