تعتبر الأصناف النباتية الجديدة أحد أشكال الملكية الفكرية التي تأكد على ضرورة حمايتها و ذلك على أساس أن الإبداع في مجال الأصناف النباتية يمثل في ذاته إبداعا فكريا يحمى كما عليه الحال في نظام براءة الاختراع و عند حصول الحائز على شهادة الحيازة النباتية وفقا للقانون 05-03 المتعلق بالبذور و الشتائل و حماية الحيازة النباتية يستفيد من حماية قانونية تمكنه من طلب التعويض في حالة استغلال الصنف النباتي بدون ترخيص منه.
و يترتب على تحصل الحائز على شهادة الحيازة النباتية الحق في استئثار استغلال الصنف النباتي دون الغير كما يستطيع صاحبه التصرف فيه بكافة أنواع التصرف بمعنى حقه في بيعه أو انتاجه أو إعادة انتاجه و استيراده أو تصديره و كذلك الحق في تخزينه.
Abstract EN
Plant variety protection is a form of intellectual property protection that allows breeders to protect new varieties of plants, much like a patent protects an invention.
When a variety certificate is issued for a variety according to Law No 05-03 relating to seeds, plants and plant variety protection, the holder enjoys legal protection in the market and may request a compensation in the event that this variety is used without authorization.
The holder also has exclusive rights to the sale, production, reproduction, import, export and storage of his variety.

La protection des obtentions végétales constitue une forme de protection de la propriété intellectuelle qui permet aux obtenteurs de protéger de nouvelles variétés de plantes, un peu comme un brevet protégeant une invention.
Lorsqu’un certificat d’obtention végétale est délivré pour une variété en vertu de la loi no 05-03 relative aux semences, aux plants et à la protection de l’obtention végétale, le titulaire bénéficie d’une protection juridique sur le marché et peut demander une indemnisation advenant que cette variété soit utilisée sans autorisation.
Le titulaire détient également des droits exclusifs sur la vente, la production, la reproduction, l’importation, l’exportation et le stockage de sa variété.
