Abstract AR
أدى توسع المبادلات التجارية على المستوى الدولي إلى ضرورة خلق قواعد موحدة تحكم هذه المبادلات و تعتبر الاتفاقيات الدولية من بين وسائل التوحيد المعتمدة.
إلا أن هذه الأخيرة أثبتت عدم فعليتها بسبب طابعها الاختياري بالنسبة لأطراف العلاقة التي تنظمها بالإضافة إلى عجزها عن التوحيد الكلي للقواعد المتعلقة بالعمليات التجارية المعنية فضلا عن إمكانية التحفظ الممنوحة للدول المتعاقدة بشأن أحكامها.
من جهة أخرى ترتبط عدم فعلية هذه الاتفاقيات بإرادة الدول ذات سيادة التي تملك سلطة المصادقة عليها مما يؤثر على دخولها حيز التنفيذ بالإضافة إلى الاختلاف في تفسير أحكامها.
Abstract EN
The expansion of international trade has necessitated the creation of unified rules governing this trade, and international conventions are among the approved means of unification.
However, the latter have proved their ineffectiveness, because of their optional nature vis-à-vis the parties to the relationship that they regulate, in addition to their inability to unify all the rules relating to the commercial operations concerned, as well as the possibility of reservation granted to the Contracting States.
On the other hand, the ineffectiveness of these conventions is linked to the will of the sovereign states which have the power to ratify them, which affects their entry into force, in addition to the difference in interpretation of their provisions.

L'expansion des échanges commerciaux au niveau international a nécessité la création de règles unifiées régissant ces échanges, et les conventions internationales figurent parmi les moyens d'unification approuvés.
Cependant, ces dernières ont prouvés leur ineffectivité, à cause de leur caractère facultatif vis-à-vis des parties à la relation qu’elles réglementent, outre leur incapacité à unifier toute les règles relatives aux opérations commerciales concernées, ainsi que la possibilité de réserve accordée aux Etats contractants.
D'autre part, l'ineffectivité de ces conventions est liée à la volonté des États souverains qui ont le pouvoir de les ratifier, ce qui affecte leur entrée en vigueur, en plus de la différence d’interprétation de leurs dispositions.
