بعد تحقق شروط الإبرام و دخول العقد التفويضي "الوكالة المحفزة" حيز التنفيذ فإن هذا العقد يأتي مرتبا لجملة من الآثار في حق كل من السلطة المفوضة و المفوض له تمثل هدف هذه الورقة البحثية حيث: يصبح للسلطة المفوضة جملة من الوسائل القانونية التي تمكنها من متابعة التنفيذ و التي تتمثل في الرقابة والتوجيه و كذا سلطة التعديل المنفرد لالتزاماتها العقدية.
وفي المقابل و نظرا لخطورة هذه الوسائل و السلطات الممنوحة للسلطة المفوضة قدر المنظم الجزائري وضع مجموعة قيود و ضوابط يضمن من خلالها عدم تعسف السلطة المفوضة في ممارسة سلطاتها وذلك بمنح المفوض له في المقابل جملة من الحقوق لكن أقر له أيضا جملة من الالتزامات.
Abstract EN
After the fulfillment of the terms of the contract "incentive agency" enters into force, this contract will arrange for a set of effects against both the delegated authority and the authorized representative representing the goal of this research paper, where: The delegated authority shall have a number of legal means that enable it to follow up the implementation, which is oversight and direction, as well as the authority to single-amend its contractual obligations.
On the other land, and given the gravity of these means and the powers granted to the delegated authority is not arbitrary in exercising its powers, by granting the delegate in return a set of rights, but a number of obligations were also approved for him.
